Coverage of the draft guidelines published by the Sentencing Council for fines in health and safety cases has focused on the penalties for corporate dutyholders. But the proposals also include, forthe first time, suggested sentencing bands for individual offenders. The draft guidelines say courts should consider fines, community orders and custodial sentences, depending on the defendant's culpability and the seriousness of the harm they caused.
