Amendments to the Spanish Criminal Code

The 5/2010 Act, which modifies the Spanish Criminal Code, was published in the Spanish Official Bulletin (BOE) on June 23, 2010.rnAmong the several amendments the Act introduces to the Spanish Criminal Code, two are particularly relevant and are directly related to the criminal enforcement of industrial and intellectual property rights. These are:rn(a) The exclusion of parallel imports (of products protected by a trademark) as a criminal offence; andrn(b) A reduced punishment for the retail distribution of products infringing industrial or intellectual property rights.
