Italian provisions are incompatible with Community law I inasmuch as they exclude from copyright protection designs that were in the public domain before April 19, 2001, according to the opinion the Advocate General of the Court of Justice of the European Union in proceedings between two Italian firms concerning rights in the Arco lamp.
