Apple Fails Bid to Secure High Court Hearing on Lifting of Samsung Injunction

Apple Inc on December 9 failed in a bid to obtain a High Court review of a lower court decision lifting an injunction preventing the sale of Samsung's Galaxy Tab 10.1 tablet device. This means Samsung can sell the device immediately, provided it keeps account of all imports and sales. The Full Federal Court on November 30 had unanimously ruled that the temporary injunction should be lifted, but Apple immediately obtained a stay while it sought special leave from the High Court to appeal its decision.
