A jury's US$1 billion damages award against Samsung for infringing Apple Inc's smartphone patents was supported by the record and therefore Samsung is not entitled to either a judgment as a matter of law to overturn the verdict, or to new trial, the US District Court for the Northern District of California ruled on January 29 {Apple Inc v. Samsung Electronics Co, ND Cal, No. 5:ll-cv-01846-LHK, 1/29/13). The court did, however, grant Samsung judgment as a matter of law that its patent infringement was not willful. Because the infringement was not willful, the court declined to treble Apple's damage award under section 284 of the Patent Act, 35 USC 284.
