摘要

The "creative economy" is no more than an alternative label for the content layer of internet that has been commercialised. Advances in technology balkanised the content layer and has made it into more than a community for collaboration and sharing. Portions were carved out into commercial space for different types of commercial activity. This is what distinguishes the "creative economy" from the "creative commons". The former is built on self interest and profit while the latter is premised on community, sharing and collaboration. Both ride on an infrastructure that supports collaboration, sharing, freedom and access. That infrastructure is the internet and its underlying technology. The space for creation and creativity has changed but the relevant laws have not kept pace. It has been argued that this creates tensions in the creative space but is this truly the case?
