France Strikes Out Cut-Off Penalty From Three Strikes Anti-Piracy Regime

Moving quickly to implement one of the principal recommendations of the so-called Lescure Report (May 2013), the French Government has adopted Decree No. 2013-596 of July 8, 2013, repealing the regulatory provision which allowed a court to order the suspension of internet access of up to 1 month for a person found guilty of "characterised negligence". The legal concept of "characterised negligence" was introduced into French law by the 2009 HADOPI statutes (see "France Publishes Final Decree Implementing Three-Strikes Anti-Piracy Law" [24 WIPR 12, 9/1/10]) and describes the internet service subscriber who was negligent in the securing of his internet access.
