Infringers of pharmaceutical patents are not entitled to choose between damages and accounting of profits, a Canadian court ruled in a case involving Bayer Inc.'s patent for oral contraceptives Yaz and Yasmin (Bayer Inc. v. Cobalt Pharmaceuticals Co., Can. Fed. Ct., No. Nos. T-1379-13, T-1468-13 & T-1368-14, 10/27/16).
