Eli Lilly 8c Co.'s big win at the U.K.'s highest court makes it easier to prove infringement even when a defendant's product doesn't fit a patent's literal language (Actavis U.K. Ltd. v. Eli Lilly & Co., [2017] UKSC 48, UKSC, 2016/0002, 7/12/17). The Supreme Court of the United Kingdom issued a ruling July 12 explaining why Actavis U.K Ltd.'s proposed cancer drug infringed Lilly's patent, even though it used a slightly different chemical compound. The court announced the result a week earlier.
