'X' Marks the Spot in EU Shoe Trademark Fight

Spanish shoe company Munich SL successfully defended its "X" EU trademark registration from German retailer Deichmann SE's attempt to get it canceled. The European Union General Court Jan. 17 rejected Deichmann's argument that the mark should be canceled because it hadn't been used in commerce for five years. Deichmann argued the registration only covered an "X" shape, and Munich's evidence of use on the side of its shoes doesn't count because those uses differ from the figure covered by the trademark registration.
