ION Urges High Court to Reject Foreign Patent Damages Request (1)

WesternGeco LLC's request for patent infringement damages based on lost foreign contracts should be rejected because it would violate longstanding principles of international comity, ION Geophysical Corp. has told the U.S. Supreme Court. The presumption against extraterritoriality, that U.S. law only applies domestically unless Congress explicitly states otherwise, has particular force in patent law, and should block WesternGeco's request, ION said in a March 26 brief.
