CA: Pre-1914 California Water Rights Threatened

Landowners and water rights owners in California are closely watching recent actions by the California State Water Resources Control Board ("SWRCB"). The board has suggested that it is willing to issue a Cease and Desist order ("CDO") for certain property owners who claim riparian and pre-1914 water rights in the Sacramento-San Joaquin Delta watershed. A court decision handed down in May failed to stop SWRCB's actions and has increased concerns about the stability of those water rights. If SWRCB does ultimately issue a CDO in the current cases pending, the implications will be felt statewide and set a new precedence for water rights.
