Environmentalists Urge Court To Uphold Landmark Maui CWA Permit Ruling

Environmentalists are urging a federal district court to reject efforts by a Hawaii county for reconsideration of a first-time ruling that found a wastewater treatment plant needs a Clean Water Act (CWA) discharge permit for the underground injection of treated wastewater, saying the court made no errors in its ruling. "Defendant has failed to establish any error in this Court's Amended Order, much less the 'clear error' necessary to warrant reconsideration," environmentalists say in a recent brief to the U.S. District Court for the District of Hawaii in Hawai 'i Wildlife Fund, et al., v. County of Maui. Moreover, nearly all of the county's arguments were, or could have been, raised in response to the underlying litigation, and therefore they cannot be the basis for reconsideration, the environmentalists add.
