EPA enforcement chief Susan Bodine is rejecting calls from Maryland environment director Ben Grumbles for the agency to level "enforcement-related consequences" on Pennsylvania if it continues to fall short of its water pollution reduction goals in the multi-state Chesapeake Bay cleanup plan, saying the conflict is not "an enforcement question." During a Nov. 14 American Bar Association "forum" on enforcement topics in Washington, D.C., Grumbles touted work by Maryland and other states to achieve the nutrient and sediment targets in the Clean Water Act (CWA) total maximum daily load (TMDL) plan for the bay, but attacked the Keystone State for failing to meet its commitments. "We know that there are eight different enforcement-related consequences for a state that's falling behind. Pennsylvania is the state that is farthest behind, and we, Maryland, will watch very closely how EPA monitors their progress.... There are going to be some important decisions in the coming months having to do with how do you deal with states that aren't meeting their goals," Grumbles said.
