In a politically sensitive and apparently unprecedented request, the developer of the first tidal energy project on the West Coast has asked the Federal Energy Regulatory Commission to issue a declaratory order overriding licensing requirements imposed on the Puget Sound initiative by Washington state regulators and a local government on the grounds that they will effectively prevent compliance with a FERC license recently granted for the project.
