Recent Developments in Motor Vehicle Leasing and Litigation

As these developments indicate, motor vehicle leasing laws (and judicial interpretations of those laws) are in a constant state of flux. We can expect more litigation, as parties continue to fight over the meaning of leasing laws, including newly-enacted state legislation. In addition, the leasing industry will certainly renew its efforts in New York toward enactment of legislation that will protect lessors from vicarious liability for lessees' negligence. Whether motor vehicle leasing volumes will rebound or continue to decline will depend, at least partially, on the impact of legal developments and changes in the vehicle leasing market.
