After the Supreme Court's decision in Freeman, it is reasonable to expect that litigation under section 8(b) of RESPA ·will diminish substantially. With this avenue of recovery now effectively closed, litigants can be expect to focus on other RESPA sections, including RESPA's QWR provisions of section 6 and the affiliated business arrangements of section 8(c)(4).
