Markey Draft Mandates Opt-In, Disclosure for Cell Software

Rep. Edward J. Markey (D., Mass.), the co-chairman of the Bi-Partisan Congressional Privacy Caucus, has released draft legislation aimed at ensuring that wireless carriers disclose to consumers the presence of tracking and monitoring software on their phones. The draft bill - the Mobile Device Privacy Act - would also require consumers' "express consent" before the software is used for monitoring. Enforcement would be the responsibility of both the Federal Trade Commission and the FCC.
