Employee disability-employer knowledge

The Court of Appeal has recently made a decision in favour of an employer in the case of Donelian v Liberata UK Ltd. This involved claims of unfair dismissal, disability discrimination, 'whistleblower detriment' and unlawful deduction of wages.All claims had previously been heard in both the Employment Tribunal (ET) and Employment Appeal Tribunal (EAT), but the Court of Appeal was only concerned with the claim relating to disability discrimination.
