What happens when a member of your workforce is sick whilst taking holiday? The European Court of Justice (ECJ) has looked at this question in a recent case (Pereda v Madrid Movilidad SA, ECJ 10/9/2009).rnMr Pereda booked annual leave then suffered an injury at work before he was due to take his leave and was signed off sick for the entire period. He asked his employer to move his period of leave as he was unable to take his original holiday but his employer rejected his request.
