Judge dismisses motions in NJ's suit over FA plant, gives parties until May 15 to submit consent decree

U.S. Judge James Knoll Gardner of the Eastern District of Pennsylvania dismissed on April 16 as moot a number of in limine motions in New Jersey and Connecticut's lawsuit over air pollution from the Portland Generating Station, a coal-fired power plant in Upper Mount Bethel Township, Northampton County, Pennsylvania, across the Delaware River and upwind from Warren County, New Jersey. The dismissals are without prejudice for the moving party to re-file in the event the parties' consent decree is not approved. By agreement of counsel, the parties were given until May 15 to file their consent decree and until June 10 to file a motion for approval.
