Thermo Fisher seeks reconsideration of time-bar ruling, says limit in §113(g)(3) does not apply to §113(f)(3)(B)

Citing an opinion by the U.S. District Court for the Western District of Kentucky, Fisher Scientific Inc. moved on April 17 for reconsideration of the decision which held that its CERCLA §113(f)(3)(B) contribution claim for a cost-recovery settlement is time-barred with respect to contamination at the Fair Lawn Well Fields Superfund Site in New Jersey.
