Hampshire Partners says no controlling law in 3d Cir. warrants reconsideration of §113 claim time-bar ruling

Defendants Hampshire Partners Fund VIL.P. and 18-01 Pollitt Drive LLC contended on May 12 that there has not been any extraordinary circumstance or change in controlling law to require reconsideration of a decision which held that Sandvik Inc. and Thermo Fisher Scientific Inc's CERCLA §113(f)(3)(B) contribution claim for a cost-recovery settlement is time-barred with respect to contamination at the Fair Lawn Well Fields Superfund Site in New Jersey. The case is in federal court for the District of New Jersey. (See issue of April 15, 2014 P. 9.)
