Looking at a consent decree as a whole, the New Jersey Department of Environmental Protection asked the federal court for the District of New Jersey on June 25 to order RP Trust to continue work at the Gloucester Environmental Management Services Inc. (GEMS) Landfill site in Gloucester Township, New Jersey, beyond the allotted 10-year period until containment of a contaminated groundwater plume. The brief says, "Considering that the RP Trust has not shown themselves to have met the requirements of ¶11(b) and (e), they could not in good faith claim to have met the requirements of the consent decree as a whole. NJDEP should not be forced to accept delivery of a GWE (groundwater extraction system) that has not been proven effective to protect the environment, the whole purpose of the consent decree.
