Citgo has sued a Florida marketer for failing to honor the terms of its jobber contract. The refiner alleges in a lawsuit filed in federal court in Oklahoma that Global Energy USA, LLC, owes it $2.8 million According to Citgo, Daytona, Fla.-based Global was required to pay by EFT for gasoline within five days. But since March 17, all EFT attempts by Citgo have been returned unpaid by Global's financial institution. Citgo stopped supplying the firm in March, says an attorney for the refiner. Global signed up with Citgo in 2005. In 2006, Kushal Yekundi, also named in the suit, executed a personal guaranty to Citgo in the amount of $0.5 million to guarantee Global's debts. The guaranty was in effect at all times relevant to the complaint, Citgo claims.
