The Court of Appeal has ruled that the HSE's pay system, which links pay to length of service, is unfair, upholding an earlier decision by the Employment Appeal Tribunal. Christine Wilson was employed as a band 3 inspector by the HSE and presented a claim for equal pay in July 2002, relying on three comparators, who were also band 3 inspectors and whose work had been rated as equivalent by a job evaluation study.
