The Employment Appeal Tribunal (EAT) has found in J Bowers v William Hill Organisation Limited, that where an employer concedes to a tribunal that an employee was disabled within the meaning of the Disability Discrimination Act iggs (DDA) at the date of the statutory tort, it cannot later claim that it had no knowledge of her disability, or the duty to make a reasonable adjustment. Such a concession would cover all aspects of the definition of disability and it would not be necessary to consider specific aspects, such as how long it would last or whether it had a substantial adverse effect.
