Employers face heavier penalties for breaching health and safety legislation from January 2009.The Health and Safety (Offences) Act 2008 has received royal assent and amends section 33 of the Health and Safety at Work etc Act 1974, raising the maximum penalties available to the courts for a number of offences.rnSpecifically, the Act raises the existing ceiling on the level of fines that can be imposed by the lower courts from ￡5,000 to ￡20,000 for most health and safety-related offences; allows both lower and higher courts to impose a prison sentence; and enables certain offences that currently can only be tried in the lower courts to be tried by a higher court.
