A council worker with diabetes who was dismissed for allegedly watching online pornography on a work computer was dismissed unfairly, the Employment Appeal Tribunal (EAT) found. The EAT upheld the employment tribunal finding of unfair dismissal -because the employer, Edinburgh City Council, had not 'engaged with the claimant's defence' - and upheld an order that the employee be reinstated, but overturned a finding of disability discrimination.
