A three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit panel has questioned U.S. Department of Energy (DOE) on how the agency justifies collecting $750 million in nuclear waste fund fees annually from nuclear power companies while providing a permanent repository for spent nuclear fuel remains unresolved. The National Association of Regulatory Utility Commissioners (NARUC) and the Nuclear Energy Institute (NEI) have challenged the continued collection of the fees, arguing that DOE has taken no action to dispose of the waste.
