NRC rejects UniStar's Unit 3 'negation' plan

Since last November, Electricite de France (EDF), currently the sole owner of UniStar Nuclear Energy, has been trying to convince the Nuclear Regulatory Commission that UniStar is eligible to build and operate nuclear power plants in the United States. Constellation Energy's withdrawal from the UniStar partnership last October meant that UniStar was not in compliance with NRC regulations that prohibit foreign ownership of U.S. power reactors (10 CFR Part 50.38) unless a "negation" plan were to be put in place to prevent foreign influence. UniStar submitted such a plan, but on April 6, the NRC informed UniStar that the plan does not comply with 10CFR50.38. This means that UniStar will have to submit a different plan that does comply, or find another U.S.
