UNISTAR: DESPITE EDF OWNERSHIP,CALVERT CLIFFS UNDER U.S. CONTROL

Though U.S. law prevents foreign control of a nuclear plant, UniStar executives presented a plan to the Nuclear Regulatory Commission to allow the French-owned company to license a proposed new reactor in Maryland. UniStar began as a joint venture between the U.S. company Constellation Energy and Electricite de France, but EDF bought Constellation's share of UniStar in the fall after Constellation rejected a Department of Energy loan guarantee offer. The French takeover of the venture brought into question whether the NRC could legally license a proposed third reactor at Calvert Cliffs, as The Atomic Energy Act of 1957 specifies that the NRC can not issue a license to an entity if "it is owned, controlled or dominated by an alien, a foreign corporation, or a foreign government."rnDespite now being fully owned by EDF, UniStar executives presented a "negation action plan" at NRC headquarters last week that they said would allow the company to be licensed to operate a reactor.
