The court was required to determine a new ground of appeal raised following the determination of an appeal between the appellant ("L") and respondent local authority in respect of whether land should be registered as a town or village green ("TVG"). An application had been made to register an area of land comprising land owned by L and land owned by the local authority as a class C TVG, pursuant to the Commons Registration Act 1965 s.22(lA), which required that to fall within that section the land had to have had for not less than 20 years "a significant number of the inhabitants of any locality, or of any neighbourhood within a locality" indulging on it "in lawful sports and pastimes as of right".
