The appeals were made under: (a) s.195 of the TCPA 1990 against a refusal to grant a certificate of lawful use or development under s.l91(1)(a) for use of part of the ground floor of a doctors' surgery as a dispensing pharmacy; and (b) s.174 of the TCPA 1990 against an enforcement notice alleging the change of use of the Land from use as Medical Centre (Use Class D1) to a mixed use comprising a Medical Centre (Class D1) and a Pharmacy (Class A1) resulting in a sui generis use. The inspector gave the following decision.
