The horrific events of September 11th and many of the government's actions taken in response to those events have touched virtually every aspect of American life. Not the least of those efforts is in the area of hazardous materials transportation regulation where the post-September 11th dissipation of the Department of Transportation's formerly centralized regulatory authority to other agencies throughout the government has created the opportunity to complicate, if not seriously disrupt, the flow of hazardous materials to, from and within the United States. For those of us old enough to recall the situation which existed prior to the creation of the Department of Transportation and the subsequent passage of the Hazardous Materials Transportation Act when the Jederal hazardous materials transportation regulatory program was divided among three different agencies, the potential for onerous, expensive, inconsistent and unnecessary regulation resulting from aggressive, eager-to-pursue terrorism bureaucracies is manifest.
