Although the principal regulatory responsibility for identifying and, at least in the first instance, dealing with out-of-compliance hazardous materials shipments falls upon the carriers, it is also the shipper's responsibility to ensure the shipment complies with the HMRs prior to transportation. In this regard, non-conforming shipments are most effectively addressed and corrected through collaboration between carriers and shippers-before such shipments are transported. As a consequence, companies with employees who prepare, offer, or accept hazardous materials should take great care to ensure that these individuals are thoroughly familiar with the foregoing requirements, including, most importantly, mandatory actions for out-of-compliance shipments, as well as rules requiring prompt incident reporting. By working together, the likelihood of an incident or accident will be reduced and the overall safety of our national transportation system will be enhanced.
