PHMSA Publishes HM-257 Final Rule and Creates Firework Certification Agencies

On July 16, 2013, the Pipeline and Hazardous Materials Safety Administration (PHMSA) issued an HM-257 final rule (Docket No. PHMSA-2010-0320; HM-257). Citing a desire to expedite the approval process for transport of 1.4G consumer fireworks (UN0336), the final rule creates a new type of DOT-approved certification agency: the Firework Certification Agency (FCA). These FCAs will provide an entirely optional alternate agency for manufacturers or designated U.S. agents to submit applications of approval. In addition, the final rule adds a new definition for "consumer firework" under § 173.59, and creates a new "FC" numbering scheme distinct from the "EX" numbering system. HM-257 amends, appends, or otherwise revises 49 CFR 107, 171, 172, and 173.
