摘要

Anticompetitive agreements and concerted practices which include direct or indirect restriction of competition via vertical and/or horizontal agreements or practices are prohibited under the Competition Act. There are group exemptions for vertical agreements and specific sectors, as well as for research and development and technology transfer activities and individual exemptions are possible. Under Turkish competition law, a dominant position is described as the power of one or more undertakings to determine economic parameters independently from customers and competitors. Being in a dominant position is not prohibited per se. Abuse of a dominant position is prohibited and such abuse can be committed either by individual or collective acts or through agreements.
