Mechanism for Resolving Jurisdictional Conflicts between Competition Commission & Sector Regulators by the Supreme Court of India in CCI v. Bharti Airtel: A Possible Approach for the Current EU cases in the Digital Sphere
While the Supreme Court judgment can be said to be a step in a positive direction and a possible mechanism to be adopted in the cases of overlap between competition and sector-specific issues, there is still a requirement for a comprehensive framework based on coordination and cooperation between the authorities. Some of the suggestions that have been made for such framework are: 1. Amendments in the Competition Act and sector-specific laws requiring mandatory and binding consultation between the authorities.
