Dachregelung europäisches Lebensmittelrecht — Vorschläge zur Umsetzung des Weißbuches zur Lebensrnittelsicherheit

Over the last 40 years European food law has seen a number of proposals for a framework act. The author takes the view that after the Commission's most recent White Paper on food safety it is now time to lay down some high quality basic rules; these ought to cover the complete production process from farm to fork, respect scientific research, guarantee uniform standards all over Europe and be flexible and adaptable to new developments. Such a statute, be it an EC-directive or an EC-regulation, would have to be applicable to all products and participants, define the term food as opposed to drugs as well as other essential terms like additives or ingredients, establish unambiguous advertising rules, clearly allocate responsibilities, comprise the principle of mutual recognition, deal with im- and export and perhaps also include standards of risk management. The author stresses the importance of stakeholders participating and of respecting their opinions in the legislation process. In any event, for political reasons a framework act would have to carefully confine itself to the urgent basic principles at the beginning; only then could it be launched soon and leave scope for future evolvement.%Die Zeit ist reif für ein europäisches Lebensmittelrahmenrecht. Vor dem Hintergrund des Weißbuchs zur Lebensmittelsicherheit macht der Autor grundlegende Vorschläge für eine solche Dachregelung. Er blickt zuerst zurück auf die Vorgeschichte. Ausgehend von den vorrangigen Schutzzwecken des Lebensmittelrechts (Schutz der Gesundheit sowie Schutz vor Irreführung und Täuschung) präsentiert er dann essentielle Anforderungen an Form und Inhalt, die ein europäisches Gesetz erfüllen müßte. Dazu gehören vor allem einheitliche Grundbegriffe, die Erfassung der gesamten Produktionskette, klare Verantwortlichkeiten und eine Einbindung in das internationale Lebensmittelrecht. Außerdem gibt der Autor Anregungen für Verbesserungen des Verwaltungshandelns, insbesondere des bestehenden Schnellwarnsystems. Er betont schließlich, daß man sich zunächst auf Eckpfeiler einer Dachregelung beschränken sollte, um das Projekt nicht von Anfang an zu überfrachten.
