Wo kommt es her, wo geht es hin? Die Entwicklung und Ausweitung der Herkunftskennzeichnung im Lebensmittelrecht

Voluntary indications about the country of origin and the place of provenance of foodstuffs have long been popular marketing tools. They address topics such as the protection of business interests and the prevention of consumer deception. However, the EU- and national legislators have recently shown increa sed interest in mandatory indications about origin and provenance of foodstuffs in order to enhance transparency. Against this background the author summarizes the legal history of such indications in German and EU food law and analyses whether mandatory indications about origin and provenance of foodstuffs are appropriate measures to achieve the intended legislative goals. The focus of the analysis is on Food-Information-Regula-tion (EU) No. 1169/2011 with mandatory labeling provisions in Art. 26 FIR.%Der 27. Deutsche Lebensmittelrechtstag in Wiesbaden hat sich unter anderem mit dem Thema „Vertrauen durch Transparenz" beschäftigt. Zu diesem Thema skizziert der Autor, dessen Beitrag auf seinem Vortrag in Wiesbaden beruht, die Entwicklung verschiedener Formen von Herkunftskennzeichnung im Lebensmittelrecht. Dabei wird, insbesondere im Zusammenhang mit dem neuen europäischen Kennzeichnungsrecht, eine Tendenz zu verpflichtenden Herkunftsangaben deutlich, deren Berechtigung der Autor kritisch beleuchtet.
