As a result of several symposia held in 2003, political scientist Stefan Kapsch, historian Manfred Berg and lawyer Franz Streng present a number of essays by both American and German authors on recent developments and discussions on German and US criminal law. The book is split into two parts, the first dealing with US law and the second with German law.rnThe American section begins with historical essays on race issues and the history of lynching in the southern states. It continues with two works on the death penalty. Particularly, Peter A. Ozanne's 'Why does America still have a death penalty?' offers some very interesting thoughts on the influence of the international community on US court rulings, as well as on the foundation of the death sentence within the democratic structure of the USA. Essays on domestic violence and gender (Annette Jolin, 'Domestic violence in the USA: a reform success'), as well as on reforms of the sentencing process (Emily Silverman, 'The constitution and the sentencing process: does modern presumptive sentencing respect defendants' rights?') follow. The US part of the book closes with 'American criminal justice as four metaphors' by Stefan J. Kapsch, in which he illustrates the foundation and procedures of US criminal justice in four metaphors (the obstacle course, the assembly line, the medieval kingdom and the pig in the python) to demonstrate the role of the actors involved.
