Brazilian Court Upholds Own Ruling, Forcing Hydro Project to Redo Impact Assessment

The consortium constructing the Belo Monte Dam in the western Amazon Basin must revise its environmental impact assessment for the project, Brazil's First Regional Federal Appeals Court (TRF1) said, upholding its own decision in March, a federal prosecutor involved in the case told Bloomberg BNA. The appeals court, in the capital of Brasilia, ruled for the second time (Case No. 0025999-75.2010.4.01.3900/ PA) because Norte Energia (NESA), the consortium building the $13 billion, 11,283-megawatt dam, appealed the March decision with the same court. The earlier decision ordered the licensing arm of Brazil's Environment Ministry (IBAMA) to require the consortium to revise its environmental assessment to reflect changes in the project (37 INER 515, 4/9/14).
