In Situation Management Systems v, ASP Consulting Group, 2008 WL 538808 (D. Mass. Feb. 28,2009), Situation Management Systems (SMS), a provider of workplace communication and negotiation workshops and associated written materials, alleged that a competitor, ASP Consulting Group (ASP), infringed SMS's copyrighted workshop workbooks and training materials. The court found that while ASP copied the materials, there was no infringement because ASP's resulting materials were not substantially similar to the copyrightable portion of SMS's materials. Two employees who helped create SMS's workshops were terminated when new ownership took over the company They became two of the founders of ASP and helped develop the allegedly infringing materials. SMS asserted that ASP copied three of SMS's workbooks.
