The United States Supreme Court granted certiorari in Board of Trustees of Leland Stanford Junior University v. Roche Molecular Systems, Inc., 2010 WL 1180644 (U.S. 2010), a case from the Federal Circuit, to address the question of whether a federal contractor university's patent rights under the Bayh-Doyle Act, 35 U.S.C.A. §§ 200 et seq., in inventions arising from federally funded research, can be terminated unilaterally by an inventor through a separate agreement purporting to assign the inventor's rights to a third party.
