Final Rules Issued on Certification, Funding of State, Local Agencies

HUD has issued final regulations revising the criteria for certifying and funding state and local fair housing agencies, making significant changes to the proposed rules. The regulations were published in the April 16 Federal Register and go into effect on May 16. The proposed rules were published on May 18, 2005. (For background, see Current Developments, Vol. 33, No. CD-11, p. 340 .) As proposed, the final rules delegate authority to suspend certification of a state or local agency to regional fair housing and equal opportunity (FHEO) directors, while leaving authority to withdraw a certification with the assistant secretary for FHEO.
