Action Apartment Association, an association of owners of developed and undeveloped multifamily properties, brought an action against the city of Santa Monica and the city council, challenging the enactment of an ordinance that modified the options for meeting affordable housing requirements. The amended ordinance increased the requirements for affordable housing from 30 to 35 percent of new construction on site or at another location or required payment of a fee in lieu of the affordable housing.
