The Seventh Circuit determined that the owner of a federally subsidized housing complex which an Illinois city condemned and razed could nevertheless sue for recovery of the HUD reserve fund on a contractual basis in either the Court of Federal Claims under the Tucker Act, or in the federal district court under a statute which allows suits by or against the government on order to carry out various subchapters of the National Housing Act.
