The Supreme Court today declined to review a George W. Bush-era rule exempting water transfers from Clean Water Act permits, leaving in place a lower-court decision that reinstated the contentious policy. Justices today issued an order denying petitions by greens and a New York-led coalition of states appealing the ruling by the 2nd U.S. Circuit Court of Appeals. EPA issued the Water Transfers Rule in 2008 excluding interbasin water transfers from permitting requirements. Such systems are common in drinking water, irrigation, flood control and power generation infrastructure throughout the country.
