Rapporteur Schwab takes open-minded approach

The member states may keep their national provisions on remedies for nondelivery of goods, as well as remedies and deadlines for lack of conformity, if such provisions are necessary, proportionate and effective. This is the compromise defended by rapporteur Andreas Schwab (EPP, Germany) on the draft directive on consumer rights. It is meant to pull together backers of total harmonisation (the European Commission) and those preferring minimal harmonisation (the Socialists and consumer associations).
